THE CONSIDERATION ON METHODOLOGY FOR LEGIALATION OF LAW FOR HPYSICAL PROTECTION AND MEASURES AGAINST RADIOLOGICAL EMERGENCY IN KOREA

Abstract
Since 1990, illicit trafficking or unauthorized removal and sabotage of nuclear materials have been recognized as an important part of physical protection. After the terrorism in the United States, the threat such as terrorism or sabotage of nuclear facilities has raised serious concern worldwide. Along with this, as a part of strengthening the international regime of physical protection, the “Legal and Technical Experts Meeting” to prepare a draft amendment of the Convention on the Physical Protection of Nuclear Material(INFCIRC/274/Rev.1) has been held under the auspices of IAEA Secretariat, with a view to strengthening the protection measures for Member States. Moreover, IAEA Secretariat has been reviewing the practical measures as well as the additional funding options relevant to assistance for Member States. In order to actively cope with the threat described above, Korean government has currently initiated to establish a new ‘Law for Physical Protection and Measures against Radiological Emergency (LPPMR)’. This paper suggests the effective methodology for its legislation by considering legal and social aspects including the relationship between domestic regulations of physical protection.
